Agreement to Terms

By downloading, installing, or using the Awful Monkey mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

1. Description of Service

Awful Monkey is a screen time management and productivity app that:

Tracks your device screen time usage
Generates personalized "roasts" (humorous critiques) based on your usage
Helps you set and achieve daily screen time goals
Provides gamification through collectible cards and achievements
Offers premium features through in-app purchases

2. Eligibility

2.1 Age Requirement

You must be at least 13 years old to use this App. By using the App, you represent that you meet this age requirement.

2.2 Parental Consent

If you are between 13 and 18 years old, you must have your parent or guardian's permission to use the App.

3. Account and Registration

3.1 Account Creation

Some features may require account creation
You are responsible for maintaining the confidentiality of your account credentials
You are responsible for all activities that occur under your account

3.2 Accurate Information

You agree to provide accurate and complete information when creating an account or making purchases.

4. License and Usage Rights

4.1 Limited License

We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes.

4.2 Restrictions

You may NOT:

Modify, reverse engineer, or decompile the App
Remove copyright or proprietary notices
Use the App for illegal purposes
Attempt to gain unauthorized access to our systems
Sell, rent, lease, or sublicense the App
Use the App to harass, abuse, or harm others
Create derivative works based on the App

5. Premium Features and Subscriptions

5.1 Premium Subscription

Price: $3.99/month (subject to change)
Features: Unlimited roasts, all personas, exclusive cards, advanced stats
Billing: Charged through Apple App Store or Google Play Store
Auto-Renewal: Subscription automatically renews unless cancelled

5.2 In-App Purchases

Individual persona packs: $1.99 - $3.99
Intensity unlocks: $0.99 - $1.99
All purchases are final and non-refundable except as required by law

5.3 Cancellation

You may cancel your subscription at any time through your device's subscription settings
Cancellation takes effect at the end of the current billing period
No refunds for partial subscription periods

5.4 Price Changes

We reserve the right to change subscription prices with 30 days' notice. Existing subscribers will be notified before price changes take effect.

6. User Content and Conduct

6.1 Your Data

You retain ownership of your data (goals, preferences, usage history)
By using the App, you grant us a license to use your data to provide services
We may use anonymized, aggregated data for analytics and improvements

6.2 Prohibited Conduct

You agree NOT to:

Violate any laws or regulations
Infringe on others' intellectual property rights
Transmit viruses or malicious code
Interfere with the App's operation
Attempt to bypass security measures
Use automated systems (bots) to access the App

7. Screen Time Permissions

7.1 Required Permissions

The App requires access to your device's screen time data to function properly.

7.2 Data Usage

Screen time data is used solely to:

Generate personalized roasts
Track progress toward goals
Calculate statistics and achievements
Unlock cards based on usage patterns

7.3 Permission Revocation

If you revoke screen time permissions, core features of the App will not function.

8. Intellectual Property

8.1 Ownership

All content, features, and functionality of the App are owned by Moodffy and protected by copyright, trademark, and other intellectual property laws.

8.2 Trademarks

"Awful Monkey," "Moodffy," and related logos are trademarks of Moodffy. You may not use these without written permission.

8.3 Feedback

If you provide feedback or suggestions, we may use them without obligation to compensate you.

9. Disclaimer of Warranties

9.1 "AS IS" Basis

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.

9.2 No Guarantee

We do not guarantee that:

The App will be error-free or uninterrupted
Defects will be corrected
The App is free of viruses or harmful components
Results from using the App will meet your expectations

9.3 Health Disclaimer

The App is for entertainment and motivational purposes only. It is not a substitute for professional medical, psychological, or therapeutic advice. Consult professionals for serious issues related to phone addiction or mental health.

10. Limitation of Liability

10.1 No Liability for Damages

TO THE MAXIMUM EXTENT PERMITTED BY LAW, AWFUL MONKEY SHALL NOT BE LIABLE FOR:

Indirect, incidental, special, consequential, or punitive damages
Loss of profits, data, use, or goodwill
Service interruptions or data loss
Any damages arising from your use of the App

10.2 Maximum Liability

Our total liability shall not exceed the amount you paid for the App in the 12 months preceding the claim.

11. Indemnification

You agree to indemnify and hold harmless Awful Monkey, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

Your use of the App
Your violation of these Terms
Your violation of any rights of others
Your violation of applicable laws

12. Third-Party Services

12.1 App Stores

Your use of the App is also subject to the terms of the Apple App Store or Google Play Store.

12.2 Third-Party Links

The App may contain links to third-party websites or services. We are not responsible for their content or practices.

12.3 Payment Processing

Payments are processed by Apple or Google. We do not store your payment information.

13. Termination

13.1 Termination by You

You may stop using the App at any time by uninstalling it.

13.2 Termination by Us

We may terminate or suspend your access to the App immediately, without notice, for:

Violation of these Terms
Fraudulent or illegal activity
Abuse of the service
Any other reason at our discretion

13.3 Effect of Termination

Upon termination:

Your license to use the App ends immediately
You must delete the App from your device
We may delete your data (subject to legal requirements)
Provisions that should survive termination will remain in effect

14. Dispute Resolution

These Terms are governed by the laws of France, without regard to conflict of law principles.

You may not assign these Terms. We may assign our rights and obligations without restriction.

We are not liable for delays or failures due to circumstances beyond our reasonable control.

If you downloaded the App from the Apple App Store, you acknowledge that:

These Terms are between you and Awful Monkey, not Apple
Apple has no obligation to provide maintenance or support
Apple is not responsible for addressing any claims relating to the App
Apple is a third-party beneficiary of these Terms

19. Google Play Store Additional Terms

If you downloaded the App from Google Play, you acknowledge that:

Google has no obligation to provide maintenance or support
Google is not responsible for addressing any claims relating to the App

20. Acknowledgment

BY USING AWFUL MONKEY, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY THESE TERMS OF SERVICE.
